Matt Boch Comments on Potential Impact of Wayfair Decision in Arkansas

Dover Dixon Horne member Matt Boch spoke with Bloomberg BNA earlier this week as the Arkansas Department of Finance advised remote sellers to begin collecting state sales and use tax in the aftermath of South Dakota v. Wayfair.

Boch told Bloomberg BNA that the DFA’s new FAQ guidance it recently published instructing remote sellers to collect tax “may be more aspirational than something where the state is going to put the hammer down.”

In terms of likely state responses, Boch believed Arkansas “could do a South Dakota-style economic nexus by changing the regulation,” but “the more likely approach” is legislation when lawmakers return to Little Rock in January.
